Terms of Service

1. Acceptance of Terms
By engaging the services of Margate Irrigation, accessing our website, or submitting an enquiry or request for a quotation, you confirm that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services or website.
2. Services
Margate Irrigation provides water and irrigation-related services including, but not limited to, borehole drilling and repairs, water tank and pump installation and repairs, sewage tank installation and maintenance, and UV filtration and water testing. All services are subject to availability, site conditions, and the terms of an agreed quotation.
3. Quotations
All quotations provided by Margate Irrigation are valid for 30 days from the date of issue unless otherwise stated. Quotations are based on information available at the time of assessment and may be subject to revision if unforeseen site conditions are encountered during work. No work will commence without a signed acceptance of quotation or written confirmation from the client.
4. Payment Terms
Unless otherwise agreed in writing, payment is due upon completion of services for residential clients. For larger or commercial projects, a deposit may be required prior to commencement, with the balance due on completion. Margate Irrigation reserves the right to charge interest on overdue amounts at a rate of 2% per month. Failure to pay may result in the suspension of services and legal action to recover outstanding amounts.
5. Client Responsibilities
The client is responsible for ensuring safe and unobstructed access to the work site, providing accurate information regarding site conditions and existing infrastructure, obtaining any necessary local authority approvals or permissions prior to commencement, and notifying Margate Irrigation of any known underground services, cables, or pipes in the work area. Margate Irrigation will not be liable for damage to undisclosed or incorrectly described underground infrastructure.
6. Warranty
Margate Irrigation provides a 12-month workmanship warranty on all completed installations. This warranty covers defects arising from faulty installation and does not cover damage caused by misuse, neglect, third-party interference, power surges, or normal wear and tear. Equipment and materials are subject to the manufacturer's warranty terms. Warranty claims must be submitted in writing within the warranty period.
7. Limitation of Liability
To the fullest extent permitted by applicable law, Margate Irrigation's liability to any client for any claim arising from the provision of services shall not exceed the total amount paid by the client for the specific service giving rise to the claim. Margate Irrigation shall not be liable for any indirect, consequential, or economic losses, including loss of income, loss of business, or property damage not directly caused by our negligence.
8. Cancellations
Cancellations must be submitted in writing. If a client cancels after a quotation has been accepted and materials have been ordered or work has commenced, Margate Irrigation reserves the right to recover costs incurred up to the point of cancellation, including material costs, call-out fees, and any preparatory work completed.
9. Dispute Resolution
In the event of a dispute, the parties agree to first attempt to resolve the matter through good-faith negotiation. If the dispute cannot be resolved informally within 30 days, either party may refer the matter to mediation or, failing that, to the courts of the Republic of South Africa. These terms are governed by South African law.
10. Changes to These Terms
Margate Irrigation reserves the right to update or amend these Terms of Service at any time. Changes will be effective from the date of publication on our website. Continued use of our services following any changes constitutes acceptance of the revised terms.
